1. General - Scope of Application
These GTTC apply to the legal relationship arising from the purchase and/or use of day tickets, general tickets and/or other, e.g. VIP, tickets (collectively "tickets") from the Chiemgau Arena GmbH, Biathlon Centre 1, 83324 Ruhpolding ("Chiemgau Arena GmbH") or from sales outlets authorised by the Chiemgau Arena GmbH, in particular for the attendance of events (co-)organised by the Chiemgau Arena GmbH ("events"), as well as the access to and stay in the Chiemgau Arena.
2. Offer, conclusion of the contract, content of the contract, presentation of the ticket at the entrance
2.1 Purchase channels:
Tickets may only be purchased (by telephone, e-mail or online) through the sales channels authorised by Chiemgau Arena GmbH. These are:
a) The Tourist Info Ruhpolding (ticket sales on site at Bahnhofstraße 8, 83324 Ruhpolding, order by telephone at 08663/88060 or order by e-mail to [email protected] or [email protected]).
b) The official website of the OC Ruhpolding: www.biathlon-ruhpolding.de, with the link to the organiser's shop https://biathlon-ruhpolding.reservix.de. Tickets are purchased via the exclusive ticket partner of Chiemgau Arena GmbH, Reservix GmbH (with the brands Reservix and ADticket; together "Reservix").
c) The official websites of Reservix: www.reservix.de and www.adticket.de.
d) The authorised Reservix advance booking offices and ticket shops, which are listed on the website www.reservix.de/vorverkaufsstellen and at www.adticket.de/Liste-der-Vorverkaufsstellen.html.
e) Box office at the Chiemgau Arena event site.
f) Other sales outlets expressly authorised and marked by Chiemgau Arena GmbH (e.g. sales via the ticket shop of the German Ski Association and its subsidiaries).
When purchasing tickets via sales outlets authorised by Chiemgau Arena GmbH, in particular the ticket partner Reservix and/or the German Ski Association, further GTC may apply. Should these GTC contain provisions that contradict these GTC of third parties, these GTC shall take precedence in the relationship between the customer and the Chiemgau Arena GmbH, provided that they have been duly included in the purchase process or at the latest upon entry to the Chiemgau Arena.
The customer acknowledges that Chiemgau Arena GmbH is entitled for good cause, e.g. due to prescribed protective measures in the context of pandemic control, to restrict the purchase channels for tickets, e.g. to online sales. The customer also expressly acknowledges that Chiemgau Arena GmbH may give preference to certain customer groups (e.g. customers with vouchers), particularly in the event of higher demand. There is no right of recourse against Chiemgau Arena GmbH in this regard, and there is expressly no entitlement to the purchase of an admission ticket.
2.2 Order:
In the case of an online order, the purchase options presented on one of the above-mentioned purchase paths do not contain a contractual offer on the part of Chiemgau Arena GmbH, but only an invitation to submit an offer by the customer. With the online command provided for this purpose, the customer submits a binding offer to Chiemgau Arena GmbH to purchase the selected admission tickets. The contract is concluded when the order is confirmed or the desired tickets are made available electronically in the so-called "print@home" procedure for printing, sent by post or handed over at the point of sale. In the event of an order placed on site or by telephone, the contract shall be concluded upon delivery or dispatch of the admission tickets.
2.3 Right of access:
Chiemgau Arena GmbH does not wish to grant access to events to everyone, but only to those ticket holders who have purchased tickets as a customer of Chiemgau Arena GmbH or an authorised sales outlet or within the scope of a permissible transfer in accordance with Clause 5.2 and, if applicable, fulfil further applicable admission requirements (e.g. in accordance with Clause 2.4). Chiemgau Arena GmbH therefore only grants a right of access ("right of access") to personalised customers who are identifiable by means of individualisation features printed on the admission ticket (e.g. barcode/QR code and/or booking number, etc.) and/or to secondary purchasers who have acquired admission tickets in accordance with Clause 5.2 and who fulfil any further applicable admission requirements (e.g. in accordance with Clause 2.4). The right of access ends when the ticket holder leaves the Chiemgau Arena event grounds for the first time. In the event that tickets are purchased in the context of an unauthorised transfer in accordance with section 5.2, there shall be no right of access. In this case, Chiemgau Arena GmbH reserves the right to refuse access. Claims for recourse against Chiemgau Arena GmbH are excluded in this case. The customer must carry a suitable official identification document (e.g. identity card, passport) as proof of identity and present it on request. Chiemgau Arena GmbH fulfils its obligations with regard to the right of access of the customer or the respective ticket holder by granting one-time access to the event. Chiemgau Arena GmbH is also released from its obligations if the ticket holder has not acquired an effective right of access in accordance with this clause. The customer has no claim that a specific competition will be held on that day, even if a specific competition is indicated on the admission ticket.
2.4 Special access conditions / pandemic control:
If, for an important reason, e.g. due to specified protective measures in the context of pandemic control or in the context of a partial exclusion of spectators due to official instructions in accordance with Item 6.3, certain requirements must be fulfilled by the customer and/or proof is required for the purchase of tickets and/or access to the event site (e.g. vaccination proof and/or proof of convalescence; mask obligation), Chiemgau Arena GmbH is entitled to obtain this proof from the customer in the sense of the data protection regulations. If, due to official instructions, certain requirements have to be met by the customer and/or proof is required for the purchase of tickets and/or access to the event site (e.g. proof of vaccination, proof of testing and/or proof of convalescence; mask requirement), Chiemgau Arena GmbH is entitled and obliged, within the framework of the data protection regulations, to have this proof presented by the customer as a prerequisite for access (at the latest immediately before access or to stay on the event site) and to check compliance with specified requirements. If the customer is unable to meet the relevant requirements, Chiemgau Arena GmbH may refuse the purchase of tickets and/or access to the Chiemgau Arena or expel the customer from the Chiemgau Arena. If tickets have already been purchased, the customer and Chiemgau Arena GmbH may in this case withdraw from the contract for the purchase of tickets for the event in question. The customer will receive a refund of the price paid less any fees incurred (e.g. service and shipping fees) on presentation or sending of the original ticket(s) on their own account, or in the case of electronic tickets, by stating the corresponding order number. Clause 6.3 concerning vouchers shall apply accordingly. The right of withdrawal shall be forfeited if the customer has once gained access to the event site under the applicable admission conditions and has thus impliedly agreed to these admission conditions.
The customer also acknowledges that Chiemgau Arena GmbH is entitled to set up specific access time windows for certain ticket holders for good cause, e.g. due to specified protective measures in the context of pandemic control and for the purpose of avoiding large gatherings of people. In this case, the respective admission ticket holder is obliged to comply with the corresponding requirements. In the event of intentional or negligent non-compliance, the ticket holder may be denied access to the event premises outside the specified time window without compensation.
Furthermore, the customer acknowledges that for good cause, e.g. due to specified protective measures within the framework of pandemic control, in particular due to official instructions or orders of the responsible association (e.g. protection and hygiene concepts), additional regulations, provisions and requirements may become valid in connection with the purchase of admission tickets, access to and stay on the event premises, expressly also beyond the scope of application of Clause 12. These will then be made available to the customer in good time and must be observed by the customer from the time they are announced. For example, it may be necessary that the customer, e.g. for the purpose of tracing chains of infection within the framework of specified protective measures of pandemic control, is requested to transmit further data on his person and/or his companions (see permissible disclosure clause 5.2) to Chiemgau Arena GmbH in accordance with the respective applicable data protection provisions. It may also be necessary for customers, e.g. for the purpose of complying with distance regulations within the framework of specified protective measures of pandemic control, to be requested to take up another place in the Chiemgau Arena or to be subject to certain information or reporting obligations. The instructions and regulations must be followed accordingly. If the customer does not agree with these instructions and regulations, he/she may - provided the purchase of tickets has already taken place - withdraw from the contract for the purchase of tickets for the event concerned. The customer will then be refunded the price paid less any fees incurred (e.g. service and shipping fees) upon presentation or sending of the original ticket(s) for his/her own account or, in the case of electronic tickets, by stating the corresponding order number. Clause 6.3 concerning vouchers shall apply accordingly. The right of withdrawal shall be forfeited if the customer has once gained access to the event premises in accordance with the applicable additional rules, regulations and requirements and has thus impliedly agreed to these conditions of access.
2.5 Admission and residence rules:
Upon entry to the event, each visitor is obligated to have his clothing scanned by a metal detector (or other technical aids) used by the security service to determine whether the visitor is carrying any items prohibited by the stadium regulations that may not be brought into the event area. Upon request, the security service must be allowed to inspect any containers (bags, backpacks, etc.) that have been brought into the event area.
Chiemgau Arena GmbH, as the event organiser, exercises domiciliary rights on the event grounds during the event. In the interest of safety and an orderly and smooth running of the event, every visitor is obliged to follow the necessary instructions of the organiser, the police, the fire department or the security forces working for the organiser.
Every visitor to an event must behave on the event premises in such a way that other persons or third-party property are not harmed, endangered or unless unavoidable under the circumstances - other persons are not hindered or inconvenienced.
Persons who do not comply with the previously mentioned instructions and/or violate one or more points of the stadium regulations or fail to comply with applicable special requirements, persons who refuse to submit to an appropriate check or search of their person and/or the items they are carrying before entering the event premises, persons who are obviously under the influence of alcohol or drugs and/or persons who behave in a violent manner or have a concrete suspicion of such behaviour, shall be excluded from the event. the organiser or the persons authorised by the organiser to do so may refuse admission to the event site or expel them from the event site without reimbursement of the admission fee.
The Chiemgau Arena GmbH, as the event organiser, may be held liable by third parties for violations by individual or several spectators of the provisions of this section 2.5 and/or the stadium regulations. The Chiemgau Arena GmbH is therefore entitled to take full recourse against the responsible party/parties demonstrably identified for this purpose with regard to the resulting damage, in accordance with the requirements of the highest court jurisdiction. In the event that several persons are responsible, they are jointly and severally liable within the meaning of § 421 BGB (German Civil Code), with the consequence that Chiemgau Arena GmbH may assert a claim against a demonstrably identified responsible person with regard to the entire damage, if there was a causal connection between the contributions of all responsible persons.
3. Ticket prices, reductions, terms of payment, ticket categories
3.1 Prices:
The respective ticket prices ("Prices") stated on the order page in the ticket shop https://biathlon-ruhpolding.reservix.de or on the official website of OK Ruhpolding www.biathlon-ruhpolding.de (together: "Price Lists") shall apply.
b) Online order via www.biathlon-ruhpolding.de with redirection to the official ticket shop https://biathlon-ruhpolding.reservix.de, order via www.reservix.de, order via www.adticket.de or the ticket shop of the German Ski Association:
- Service fee per order: 2,00 EUR
- Shipping method print@home: + 0,00 EUR
- Dispatch by post: + 2,50 EUR
3.3 Cancellations:
If payment is not successfully made for reasons for which the customer is responsible (e.g. insufficient credit card or account coverage, chargeback), Chiemgau Arena GmbH is entitled to cancel the order without replacement or to electronically block the corresponding admission tickets; these will lose their validity. Any additional costs incurred are to be reimbursed by the customer. Chiemgau Arena GmbH reserves the right to assert further claims for damages.
3.4 Reductions:
Young people between the ages of eleven (11) and seventeen (17), pupils, students and severely disabled persons receive reductions on the prices according to the price lists. The respective proof of the reduction must be presented upon entering the event area of the Chiemgau Arena during the admission control. Double reductions will not be granted. For the transfer of reduced admission tickets, the regulations in section 5 apply with the additional proviso that a transfer is only possible if the new holder also fulfils the corresponding reduction requirements, unless the new holder pays a surcharge on the amount of the difference between the reduced admission ticket and a corresponding admission ticket at the box office before entering the Chiemgau Arena. An appropriate processing fee may be charged by Chiemgau Arena GmbH for upgrading an admission ticket.
3.5 Children's tickets:
Children up to the age of ten (10) also require an admission ticket. These are available free of charge, but only at the box office on the day of the event (the relevant proof must be presented at the box office). Children's tickets may not be passed on to third parties.
3.6 Re-seating:
The customer acknowledges that Chiemgau Arena GmbH is entitled for good cause, e.g. due to prescribed protective measures in the context of pandemic control and requirements for compliance with distance areas, to allocate seats of the same or a higher category to the ticket holder that deviate from the seats originally allocated. In such a case of reallocation, the customer shall have no right of withdrawal or any further claim to compensation.
4. No right of revocation and return
With its service of selling tickets for events, Chiemgau Arena GmbH offers services from the area of events/leisure activities at a specific date/period. This means that according to § 312 g para. 2 no. 9 of the German Civil Code (BGB), there is no right of revocation and/or return with regard to the tickets purchased, e.g. online. This means that a two-week right of revocation and return does not exist. Each submission of an offer or order for admission tickets is thus binding immediately after confirmation by Chiemgau Arena GmbH or the corresponding authorised agency and obliges the customer to accept and pay for the ordered admission tickets.
5 Use and passing on of admission tickets; measures in the event of unauthorised passing on of tickets
5.1 Interest worthy of protection:
In order to prevent acts of violence and criminal offences in connection with attendance at the events and to prevent the unauthorised transfer of tickets, in particular to avoid ticket speculation, and to maintain the broadest possible supply of tickets to fans at socially acceptable prices, but also as part of protective measures to combat pandemics, it is in the interest of Chiemgau Arena GmbH to reasonably restrict the passing on of tickets.
5.2 Use and unauthorised transfer:
purchaser therefore undertakes to purchase and use the admission ticket(s) exclusively for private purposes. Any commercial or other transfer / resale of purchased admission tickets without the prior written consent of Chiemgau Arena GmbH is prohibited. In particular, the purchaser is prohibited from:
a) Offering and/or selling admission tickets publicly, at auctions or on the Internet (e.g. on eBay, eBay classifieds, Facebook) and/or on sales platforms not authorised by Chiemgau Arena GmbH (e.g. viagogo, seatwave, StubHub etc.);
b) To pass on tickets at a higher price than the price paid. A price surcharge of up to 10% to compensate for transaction costs incurred is permissible;
c) To pass on admission tickets on a regular basis and/or in large numbers;
d) To sell or pass on admission tickets to commercial resellers and/or ticket dealers or ticket platforms;
e) To use or allow to be used admission tickets commercially without the express prior consent of Chiemgau Arena GmbH, in particular for the purposes of advertising, marketing, as a bonus, as a promotional gift, as a prize or as part of an unauthorised hospitality or travel package; and/or:
f) In the event that the contact details of any customer and/or ticket holder are collected (for example, by the competent authority) and are permitted under data protection law (e.g. for the purpose of tracking as part of measures to combat a pandemic) to sell or pass on tickets without informing Chiemgau Arena GmbH in good time of the passing on of the ticket, stating the required contact details of the new holder; in this case, the passing on of the new holder's data is carried out to safeguard the legitimate interests of Chiemgau Arena GmbH in accordance with Art. 6 para. 1 p. 1f) DSGVO.
5.3 Permissible passing on:
A private, non-public passing on of an admission ticket for non-commercial reasons, in particular in individual cases in the event of illness or other prevention of the customer, is permissible if there is no case of impermissible passing on within the meaning of the regulation in Clause 5.2 and the customer (1) expressly informs the new holder of the validity and content of these GTTC as well as the necessary passing on of information (e.g. surname, address and date of birth) about the new holder to Chiemgau Arena GmbH in accordance with this clause, (2) the new holder agrees to the validity of these General Terms and Conditions between him/her and Chiemgau Arena GmbH through the purchase and use of the admission ticket, (3) the new holder agrees to the disclosure of his/her name, address and date of birth to Chiemgau Arena GmbH and to the processing of this data by Chiemgau Arena GmbH for the purpose of implementing the contract and (4) Chiemgau Arena GmbH, upon request (in particular on the basis of protective or hygiene measures imposed by the association, the authorities or by law, but in each case (4) Chiemgau Arena GmbH is informed in good time of the transfer of the admission ticket, stating the details of the new holder (regularly name, address and date of birth), or Chiemgau Arena GmbH has permitted the transfer to the new holder. On the one hand, the transfer of the new holder's data takes place for the fulfilment of the contracts between him/her and Chiemgau Arena GmbH and between him/her and the customer in accordance with Art. 6 Para. 1 S. 1 b) of the DSGVO. On the other hand, this data processing is carried out to protect the legitimate interests of the Chiemgau Arena GmbH (see clause 5.1) in accordance with Art. 6 para. 1 p. 1 f) of the DSGVO.
5.4 Unauthorised removal of information on admission tickets:
It is prohibited to alter/remove the price or other elements of the admission ticket (such as warnings against unauthorised resale, dash or QR codes) on the admission ticket. In the event of a breach of this provision, Chiemgau Arena GmbH is entitled to refuse the holder of the ticket concerned access to the Chiemgau Arena without compensation and to block the ticket concerned.
5.5 Contractual penalty:
In the event of a breach by the purchaser of these General Terms and Conditions of Business, in particular of the obligations under clause 5.2 and/or 5.4, Chiemgau Arena GmbH is entitled, in addition to the other measures and sanctions possible under these General Terms and Conditions of Business and without prejudice to any further claims for damages, to impose an appropriate contractual penalty of up to EUR 2,500.00 on the purchaser. The exact amount of the contractual penalty will be determined by Chiemgau Arena GmbH on a case-by-case basis at its reasonable discretion and, in the event of a dispute, its appropriateness shall be subject to judicial review. The amount of the contractual penalty shall be determined in particular by the number and intensity of the violations, the type and degree of fault (intent or negligence), the efforts and successes of the customer in making the damage, the question of whether and to what extent the customer is a repeat offender, and, in the case of unauthorised resale of tickets, the number of tickets offered, sold, passed on or used, as well as any proceeds or profits generated by the resale.
In the event of an unauthorised transfer of tickets pursuant to Section 5.2 and/or 5.4, Chiemgau Arena GmbH is entitled, in addition to the imposition of a contractual penalty and in addition to the other sanctions possible under these GTCs, to have the customer pay out, in whole or in part, the additional proceeds or profit generated by the unauthorised transfer of tickets.
5.6 Exclusion from the purchase of tickets:
Exclusion from the purchase of tickets: Chiemgau Arena GmbH reserves the right to exclude purchasers who violate the obligations in section 5.2 and/or 5.4 from the purchase of tickets in the future.
6. Event dates, postponement of events, cancellation
6.1 Initial situation:
The events held in the Chiemgau Arena are open-air events, so that the staging and times of the individual competitions can be influenced by the weather. In addition, Chiemgau Arena GmbH is bound by the specifications and rules of the national and international sports associations when staging the events and the individual competitions. The days and times stated, e.g. on www.biathlon-ruhpolding.de or the orderpage https://biathlon-ruhpolding.reservix.de/events, for the individual competitions held during an event are therefore non-binding.
6.2 Postponement, cancellation, abandonment:
Chiemgau Arena GmbH reserves the right to postpone the events as well as to change the programme, in particular to exchange individual competitions within the competition days. In these cases, the customer has neither a right to a refund of the price nor a right of withdrawal. If the start time for a competition is postponed to another time on the respective competition day, the ticket entitles the customer to participate in this competition as a spectator.
In the event of a cancellation up to the day before the date of the event, the price - in the case of multi-day tickets on a pro rata basis - shall be refunded on presentation of the original admission ticket, or in the case of electronic admission tickets on quoting the relevant order number and providing the bank details, at the face value less any charges incurred (e.g. service or shipping charges). Clause 6.3 concerning vouchers shall apply accordingly.
In the event of cancellation or abandonment of an event on the day of the event, in particular as a result of an unavoidable situation, e.g. due to adverse weather conditions (e.g. temperatures below minus twenty degrees Celsius (-20°C), fog, heavy snowfall), as well as in the event of obstructed visibility and/or official regulations, the customer shall not be entitled to a refund of the price paid, unless Chiemgau Arena GmbH or the organiser is responsible for the cancellation or if the conflicting interests of the customer and the interests of Chiemgau Arena GmbH or the organiser are weighed against each other in favour of a refund.
6.3 Exclusion of spectators:
In the case of an event which, according to the conditions of a competent association or authority, must take place entirely (or partially, if the customer's ticket is affected by the partial exclusion) with the exclusion of spectators, both Chiemgau Arena GmbH and the affected customer are entitled to withdraw from the contract for the purchase of tickets for the affected event. The withdrawal by the affected customer must be declared in text form (email is sufficient), by fax or in writing by post. The affected customers shall receive a refund of the price paid less any fees incurred (e.g. service or shipping fees) or a voucher to the value of the corresponding price for redemption as part of a future ticket purchase upon presentation or sending of the original ticket(s) for their own account or, in the case of electronic tickets, by stating the corresponding order number, unless the allocation of a voucher is unreasonable for the customer.
6.4 Duty to provide information:
The customer or ticket holder is obliged to inform himself/herself in good time about the respective current event schedule and the exact start of the competition in advance of the respective event/competition day for which the ticket conveys a right of admission. The latest information in this regard is available at www.biathlon-ruhpolding.de.
7. Parking and transport to the Chiemgau Arena
7.1 Parking facilities and shuttle:
In the local area of Ruhpolding, parking facilities will be provided by Chiemgau Arena GmbH during major sporting events (e.g. World Cup, World Championships) within the framework of the available (personnel, spatial and technical) capacities and official requirements, and a free shuttle bus service to the Chiemgau Arena will be set up from the individual parking spaces.
7.2 No claim to parking spaces:
However, the granting of parking facilities does not constitute any entitlement on the part of the customer to a parking space and does not imply any obligations on the part of Chiemgau Arena GmbH to monitor the parking area and the vehicles parked there. The liability of Chiemgau Arena GmbH for damage to the vehicles parked there, e.g. due to unauthorised interference by third parties, is excluded, unless Chiemgau Arena GmbH is at fault.
7.3 No entitlement to shuttle:
The provision of the free bus shuttle service to the Chiemgau Arena does not constitute any entitlement on the part of the customer to transport, not even at certain times and not even for persons who do not have a valid admission ticket. Arrival should therefore take place in good time in any case, as delays may occur - especially shortly before the start of the competition or due to official requirements for transport. Liability on the part of Chiemgau Arena GmbH for late arrival at the Chiemgau Arena is excluded, unless Chiemgau Arena GmbH is at fault.
8. Liability of the Chiemgau Arena GmbH
The Chiemgau Arena GmbH is liable to the customer in accordance with the statutory provisions for damages only insofar as these are due to intent or gross negligence on the part of the Chiemgau Arena GmbH, its representatives or vicarious agents, i.e. not in the case of simple negligence. This limitation of liability does not apply in the event of culpable injury to life, limb or health or culpable breach of essential contractual obligations (i.e. obligations whose fulfilment is essential to the proper performance of the contract and on whose compliance the contractual partner may regularly rely).
9. Chiemgau Arena, Stadium Regulations
The stay at and in the Chiemgau Arena is at your own risk. Access to the Chiemgau Arena and conduct on the event site before, during and after the event is additionally subject to the stadium regulations posted there, which are an integral part of these GTTC and which can be viewed, saved or printed out on the official website of the OC Ruhpolding www.biathlon-ruhpolding.de. In particular, every ticket holder is obliged to behave in the Chiemgau Arena in such a way that the legal interests of Chiemgau Arena GmbH, the athletes, the spectators and all other persons present at events are not impaired and/or endangered. In the event of one or more breaches by ticket holders or customers of these regulations and the rules of conduct laid down in the stadium regulations, Chiemgau Arena GmbH, the police and/or the security personnel shall be entitled to confiscate prohibited items carried by ticket holders or customers without compensation and/or to refuse ticket holders or customers access to the Chiemgau Arena without compensation and/or to expel them from the Chiemgau Arena or the stadium.
10. Picture and sound recordings
For security reasons, for public reporting and/or advertising of the event in question, Chiemgau Arena GmbH, the responsible associations and/or third parties commissioned or otherwise authorised by them (e.g. radio, press) may independently make image and sound recordings in accordance with Art. 6 para. 1 p. 1 f) DSGVO, which may show spectators at the event in question. The legitimate interest of Chiemgau Arena GmbH, the responsible associations or third parties commissioned or otherwise authorised by them in each case (e.g. radio, press) lies in the interest of also showing and exploiting the event concerned in the Chiemgau Arena in the media. These video and audio recordings may be processed, utilised and publicly reproduced by Chiemgau Arena GmbH, the relevant associations or third parties authorised by them (e.g. radio, press) within the scope of the same legitimate interest.
Video and photo recordings by visitors on event days are only permitted for private purposes and exclusively with devices which, in terms of equipment and size, are obviously intended solely for private use and do not exceed a maximum size of 150 x 150 x 150mm (WxHxD). Any other use of these recordings or disclosure of the same beyond the private sphere to third parties or publication in the media, in particular social networks (e.g. Facebook, Instagram, Twitter, YouTube, etc.) requires the prior express consent of the Chiemgau Arena. The same applies to the collection of data on event days.
11. Data Protection
Chiemgau Arena GmbH processes personal data within the framework of the GTTC and the circumstances described therein exclusively in accordance with the data protection regulations, in particular the EU Data Protection Regulation (DSGVO). For this purpose, Chiemgau Arena GmbH provides corresponding data protection information at https://www.biathlon-ruhpolding.de/de/datenschutz.
12. Choice of Law/Place of Performance/Court of Jurisdiction
The mandatory legal provisions of the country in which the customer usually resides shall apply. German law shall apply in all other respects. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded. The sole place of performance for delivery, service and payment is Ruhpolding. The place of jurisdiction for all disputes arising from or in connection with these GTTC and/or their validity or legal transactions based on these GTTC is Traunstein, unless the customer is a consumer.
13. supplements and amendments
In the event of a change in market conditions and/or the legal situation and/or supreme court rulings, Chiemgau Arena GmbH is entitled, even in the case of existing contractual obligations, to supplement and/or amend these GTTC with a notice period of four (4) weeks in advance, provided that this is reasonable for the customer. For an increase in prices (by changing the price list) for existing contractual obligations, it also applies that this is only permissible in the event of market conditions changing significantly to the detriment of Chiemgau Arena GmbH, in particular in the event of a significant increase in maintenance costs or other procurement or provision costs, in the event of a change in value added tax or comparable taxes or in the event of a significant change in the consumer price index of the Federal Statistical Office (minimum increase of 0.5 percentage points compared to the same period of the previous year).
14. final clause
Should individual clauses of these GTTC be invalid in whole or in part, this shall not affect the validity of the remaining clauses or the remaining parts of such clauses. An invalid provision shall be replaced by the parties with a provision which comes as close as possible to the economic purpose of the invalid provision. The same shall apply to any loophole in these GTTC.
