1 These promotion conditions apply to the offer of the OC Biathlon Ruhpolding, Biathlonzentrum 1, 83324 Ruhpolding, Germany ("OC Ruhpolding"), which is responsible for the implementation of the promotion on behalf of the municipality of Ruhpolding. The subject of the promotion conditions is the purchase and use of value vouchers, in particular in relation to the 2022 Biathlon World Cup in Ruhpolding ("Vouchers").
2. Participation in the promotion
a. Purchase of a Voucher worth at least € 50.00 in the official ticket store (https://biathlon-ruhpolding.reservix.de/artikel) of the Biathlon World Cup Ruhpolding or by telephone, on site or by mail in the Tourist Information Ruhpolding between 15.02.2021 and 21.03.2021;
b. With the completed purchase, the customer receives a preferential right to tickets for the 2022 Biathlon World Cup in Ruhpolding. This means: The customer will be informed four (4) weeks before the official start of sales ("Exclusive Period") and will thus have the exclusive opportunity to redeem the voucher value as part of a ticket order during the Exclusive Period. The voucher can only be redeemed via the Tourist Information Ruhpolding (by phone, on site or by mail) or by using the individual code found on the voucher via the official ticket store at https://biathlon-ruhpolding.reservix.de/events.
c. The promotion is only valid as long as the stock provided for the purchase of the voucher lasts.
3. One (1) voucher can be redeemed for a maximum of six (6) tickets.
4. The shipping of the voucher is at the expense of the customer. If the customer or a third party named by the customer takes possession of the tickets, the risk of loss and damage shall pass to the customer. If the customer is not a consumer in the sense of the law (§ 13 BGB), the transfer of risk already takes place with the handover of the tickets to the shipping company (§ 447 para. 1 BGB).
5. The voucher can be redeemed (with the exception of the regulation on the residual value according to clause 10) exclusively for tickets, which is why services from the area of leisure events/leisure activities are offered with it on a certain date/period. This means that according to § 312 g para. 2 no. 9 BGB there is no right of revocation and/or return with regard to the, e.g. online purchased, vouchers. A two-week right of revocation and return does not exist. Each offer submission or order is thus binding immediately after confirmation by the municipality of Ruhpolding or the corresponding authorized body and is obligated to acceptance and payment.
6. If the voucher is lost or if the download of the voucher fails or if the file with the voucher code is lost on the customer's computer, the risk of loss lies with the customer, unless the municipality or the OC Ruhpolding is responsible for the loss.
7. The voucher is only transferable under the following conditions. The municipality or the OC Ruhpolding can make payments to the respective holder with discharging effect. However, the OC Ruhpolding expressly reserves the right to exclude persons from the promotion if there is reasonable suspicion of unauthorized ticket trading. In particular, the OC Ruhpolding reserves the right to cancel vouchers as soon as they are offered for sale on an unauthorized platform (e.g. eBay, eBay Kleinanzeigen, etc.) and the called sales price exceeds the original price of the voucher not only insignificantly.
8. Tickets are also allocated within the exclusive period according to availability and the principle "first come, first served", i.e. redemption is subject to the availability of tickets or the desired ticket category. In particular, the purchase of a voucher does not give rise to any entitlement to redemption in a specific ticket category.
9. Each voucher can be redeemed in the year of its issue as well as in the two following calendar years. The redemption within the exclusive period, i.e. the preferential right according to point 2. b. applies exclusively to tickets for the Biathlon World Cup 2022 in Ruhpolding.
10. Any residual value on the voucher shall be retained and can be redeemed for further ticket orders or for services from the area of leisure events/leisure activities. Cash redemption of the voucher is excluded, as is the payment of interest on it.
11. The customer acknowledges already now that in case of conversion of the voucher, i.e. for the legal relationship established by the purchase and/or use of tickets, in particular for the attendance of events (co-)organized by the municipality of Ruhpolding, as well as the access and stay in the Chiemgau Arena, the ATGB of the municipality of Ruhpolding shall become valid (available at:https://www.biathlon-ruhpolding.de/de/allgemeine-ticket-und-geschaeftsbedingungen-atgb-2019202020212022
12. The OC Biathlon Ruhpolding reserves the right to adjust, modify or terminate the action at any time. Circumstances that can lead to this are e.g. disturbances of the action due to force majeure, legal reasons, technical reasons (e.g. software or hardware errors) or manipulation of the action by third parties.
13. The municipality and the OC Ruhpolding are liable to the client according to the legal regulations for damages only as far as they are based on intention or gross negligence of the municipality Ruhpolding, its representatives or vicarious agents, i.e. not in case of simple negligence. This limitation of liability does not apply in the case of culpable injury to life, body or health or culpable breach of essential contractual obligations (i.e. obligations whose fulfillment is essential to the proper performance of the contract and on whose compliance the contracting party may regularly rely).
14. The municipality of Ruhpolding and the OC Ruhpolding process personal data within the framework of the voucher award and the circumstances described herein exclusively in accordance with the data protection regulations, in particular the EU Data Protection Regulation (DSGVO). For this purpose, the municipality of Ruhpolding provides corresponding data protection information at https://www.biathlon-ruhpolding.de/de/datenschutz.
15. The mandatory legal provisions of the country in which the customer usually resides shall apply. In all other respects, German law shall apply. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded. The sole place of performance for delivery, service and payment is Ruhpolding. The place of jurisdiction for all disputes arising from or in connection with these provisions and/or their validity or legal transactions based on these provisions is Traunstein, unless the customer is a consumer.
16. Should individual clauses be invalid in whole or in part, this shall not affect the validity of the remaining clauses or their remaining parts. The parties shall replace an invalid provision with a provision that comes as close as possible to the economic purpose of the invalid provision. The same shall apply to loopholes in these provisions.
